S.C. Senator Lindsey Graham Shouldn’t Be Exempted from Testifying Before Grand Jury

The senator’s status as a federal lawmaker should not exempt him from giving testimony in the investigation into Donald Trump’s efforts to overturn the 2020 presidential election results in Georgia.

Yes, the U.S. Constitution’s speech and debate clause does prohibit asking lawmakers about their legitimate legislative functions.

But Senator Graham’s asking Georgia’s secretary of state Brad Raffensperger for ways to invalidate certain mail-in votes does not constitute a legitimate legislative function on the part of the senator.

Therefore, no exemption should be made to allow him to get away with not testifying.
